Wedding contract policies
1. Exclusive Photographer *
Amy Benoit Photography shall be the exclusive photographer retained by the client for purposes of photographing the day of the event. Family and friends will be permitted to photograph at the wedding as long as they do not interfere with the photographer's duties and do not photograph poses arranged by the Photographer(s).
2. Retainer and Payment *
The client shall pay a non-refundable retainer of $500 to secure the services and product specified herein. Upon signing this contract the amount of the retainer shall be applied to reduce the total balance of the package. The final balance must be payed one week prior to the event date.
3. Cancellation or Postponement *
If the client should cancel the event for any reason, the retainer will not be refunded. If canceling this contract, the client must notify Amy Benoit Photography in writing. To consider a date change, Amy Benoit Photography must receive a written release of the current date, which will null and void this written contract. If the client needs to change the event date all money paid will transfer to the new date per a newly written and signed contract IF the new date is available for Amy Benoit Photography. The new date must be within six months of the original day or the new contract will be subject to current rates. If the new date is unavailable with Amy Benoit Photography the contract will be cancelled and the retainer will not be refunded.
4. Photographic Materials *
Amy Benoit Photography reserves the right to maintain possession of all original files. Amy Benoit Photography retains copyrights on all images (even those given/purchased on CD) and reserves the right to use the images and/or reproductions for display, publication, advertisement, or other purposes.
5. Copyright and Reproductions *
Amy Benoit Photography shall own the copyright for all images created at the event and shall have the right to make reproductions. Amy Benoit Photography shall only make reproductions for the client, the photographers portfolio, studio samples, self promotions, entry in photographic contests or exhibitions. If the photographer desires to use the images for uses other than those above, Amy Benoit Photography shall not do so without first obtaining written permission from the client.
It is illegal to copy images that you have or have not purchased. Copying or scanning images from your gallery, or from other printed materials is considered stealing, regardless for the intent for use. We reserve the right to cancel remaining or future sessions upon discovery of copyright infringement. Under no circumstances can a client use these images for profit, commercial endeavors, in competitions, or for professional display.
As an artist Amy Benoit Photography wishes to have control over the final look of their clients images. Scanned, copied or screenshot images damage her reputation as a photographer by distorting and devaluing the image quality. Thank you for respecting Amy's work and livelihood by choosing not to reproduce her images.
6. Failure to Perform *
If the photographer cannot perform this agreement due to fire, casualty, act of God, illness, or any other cause beyond the control of the photographer then Amy Benoit Photography shall return all monies paid and shall have no further liability with respect to this contract. This limitation of liability shall also apply in the event that photographic materials are damaged without fault on the part of the photographer. In the event that Amy Benoit Photography fails to perform for any other reason, Amy Benoit Photography will not be liable for any amount in excess of the value of the Client's package.
7. Negatives (digital or otherwise) *
Images are individually edited for color correction, contrast adjustments, tonal adjustments, and conversion to black and white (if applicable). The images include a variety of techniques to create the photographers interpretation of the perfect print. Steps include but are not limited to; realistic retouching, blemish removal, selective toning of colors, tonal adjustments and color enhancements, removal of distracting elements, etc. Some images (particularly those shot in low light) may have some film grain when enlarged too much. This is normal, but may not be aesthetic. In addition, if you crop an image too tightly, you will lose resolution and may cause pixelation when enlarged.
8. Release of Negatives (Digital or Otherwise) *
By releasing the negatives (digital or otherwise) Amy Benoit Photography authorizes the Client to use the images for their own personal use. Amy Benoit Photography is not responsible for the quality of enlargements (or otherwise) from these files that have been taken to a non-professional and/or consumer photo lab. The images may not be sold or published without the written consent of Amy Benoit Photography. Amy Benoit Photography will retain the copyright of the images as well as the exclusive rights retailed in section "copyrights and reproductions". Upon release of the negatives (digital or otherwise) to the client, Amy Benoit Photography is released of all liability for archiving all of the files.
9. Officiant and Venue Restrictions *
The Photographer may be limited by the guidelines or rules of the ceremony official, ceremony venue, or reception venue. The Client understands and agrees that Amy Benoit Photography will abide by such rules and that they are outside the control of Amy Benoit Photography. The Client agrees to hold Amy Benoit Photography harmless for the impact such guidelines or rules may have on the resulting photographs.
10. Other *
The Client is responsible for covering additional costs and fees related to location choice (admission/permit fees, parking fees, etc.). Travel over 45 minutes is subject to a travel fee.
Amy Benoit Photography will not be held responsible for injury to yourself or those accompanying you to the wedding/photography session.
Your proofs will be posted in a password protected gallery within 8-10 weeks. This gallery will be hosted for 3 months. Orders must be placed within this time period to maintain a speedy workflow and to help prevent back logging for other clients. Be sure to inspect your images carefully, once orders are placed, all sales are final. Note that all images are produced with a linen finish to enhance quality and retain longevity. As such, they do not scan.
While, respecting your tastes, please allow us to have the freedom to decide how to make an image look its absolute best.
Minor retouching is included in all packages and with purchase of your prints. Major retouching may incur an additional fee.
Credits and special offers are non-transferable and are not redeemable for cash.
Amy Benoit Photography can not be held responsible for loss of files due to exceptional circumstances such as equipment failure.
